PINKAIDE Terms of Service

Effective Date: August 1, 2026

Article 1 (Purpose)

These Terms of Service (the "Terms") aim to define the conditions of use, procedures, rights, obligations, and other necessary matters between PINKAIDE ("Company") and the user ("User") regarding the use of all applications (the "Service") provided by the Company through smart devices.

Article 2 (Definitions)

① The definitions of terms used in these Terms are as follows:

  1. "Application" means any program developed and provided by the Company to be downloaded or installed on smart devices to use the Service.
  2. "User" means any individual who agrees to these Terms and uses the Service provided by the Company.
  3. "Content" means all digital materials including text, audio, music, images, and features provided within the Service.
  4. "Subscription" means a paid service model where a recurring fee is automatically charged at designated intervals (e.g., monthly, annually) for continuous access to premium features.
  5. "Lifetime Pass" means a one-time purchase model that grants access to premium features without time or frequency limits solely for the duration of the Application's active service lifespan.

② Any terms not defined herein shall be interpreted in accordance with applicable laws, regulations, and general commercial practices.

Article 3 (Effect and Amendment)

① These Terms shall be made available within the Application and shall take effect immediately upon the User installing and launching the Application.

② The Company may amend these Terms to reflect updates in applicable laws or to improve the Service. Any amendments will be notified within the Application at least 7 days prior to their effective date. Continued use of the Service after the effective date constitutes acceptance of the amended Terms.

Article 4 (Privacy and Data Security)

① As a general rule, the Company does not directly collect, store, or manage any personal identification information or membership registration data. (Authentication and in-app purchase information processed via Google Play Store accounts are governed entirely by Google’s Privacy Policy.)

② User-generated data created within the app (e.g., study logs, timer records) is stored locally on the User's smart device or their personal cloud storage. The Company shall not be held liable for any data loss resulting from device replacement, formatting, or application deletion.

Article 5 (User Obligations and Restrictions)

① All sound sources, music, and content provided within the Service are the exclusive intellectual property of the Company and may not be reproduced, distributed, commercially exploited, or reverse-engineered (decompiled) without prior written consent.

② Users shall be legally liable to indemnify the Company for any damages caused by violating these restrictions.

Article 6 (Service Provision and System Requirements)

① Users may download the Application for free and use basic features, or unlock premium features by purchasing a Subscription or a Lifetime Pass via in-app purchases.

② The Service is optimized for the latest Android OS environment supported by Google Play Services. Operation and support may be limited on outdated devices or legacy OS versions.

Article 7 (Paid Services and Payments)

① All transactions, recurring billing, and payment processing for paid products are handled exclusively through the Google Play Store billing system.

[Subscription] Subscription products automatically renew at the end of each billing cycle unless cancelled by the User through their Google Play Store account settings at least one day before the renewal date.

[Lifetime Pass] The Lifetime Pass remains valid only as long as the Application is actively maintained and offered by the Company. In the event of service termination due to technical shifts, app market policy updates, or operational closure, the Lifetime Pass will expire automatically with the discontinuation of the Service.

Article 8 (Cancellation and Refunds)

① Users may request a full refund within 7 days of purchase, provided that the premium features or content have not been used or consumed. Refunds are restricted if the premium service is immediately applied or consumed upon purchase.

[Mid-term Subscription Cancellation] If a User cancels a subscription mid-cycle, automatic renewal will be deactivated. The User may continue to access premium features for the remaining period of the current cycle; however, no pro-rated refunds will be issued for the unused days.

③ ALL REFUND PROCESSES ARE SOLELY SUBJECT TO THE GOOGLE PLAY STORE REFUND POLICIES AND SYSTEMS. The Company does not possess direct billing cancellation or cash refund authority. Users must submit refund requests directly through their Google Play Store purchase history.

Article 9 (Service Modification, Suspension, and Termination)

① Due to the operational nature of a solo developer environment, the Company reserves the right to modify, suspend, or terminate the Service, in whole or in part, based on technical errors, personal health emergencies of the operator, unsustainable server maintenance costs, or major app market policy changes.

② In the event of permanent service closure, the Company will provide a 30-day prior notice within the Application. Upon the expiration of the notice period, all subscriptions will terminate, and Lifetime Passes will automatically expire without any right to partial refunds, cash redemptions, or indemnity.

Article 10 (Disclaimer of Warranties and Limitation of Liability)

① THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

② In no event shall the Company be liable for any indirect, incidental, or consequential damages. For paid services, the Company's liability for any demonstrable willful misconduct or gross negligence shall be strictly capped at the actual amount historically paid by the User for the specific product causing the liability.

③ The Company shall be fully exempt from liability for service disruptions caused by force majeure, server hosting outages, hardware deficiencies, or network disconnections outside of the Company's reasonable control.

Article 11 (Governing Law and Jurisdiction)

These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea. Any disputes arising out of or in connection with the use of the Service shall be submitted to the exclusive jurisdiction of the courts prescribed by applicable civil procedure laws.

Addendum

These Terms of Service shall enter into force on August 1, 2026.
